Terms of Service

1. Acceptance of Terms

By accessing or using ProHeadshots ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these terms, please do not use the Service.

2. Eligibility

You must be at least 18 years of age or have the legal authority to enter into a binding agreement in your jurisdiction to use the Service. By using ProHeadshots, you represent that you meet this requirement. We do not knowingly provide services to anyone under 18.

3. Service Description

ProHeadshots provides AI-powered headshot generation services. You upload photos, and our AI technology generates professional headshot images based on your selections. The Service may also include related tools such as resume packs, QR profiles, business cards, and other features as described on the platform.

4. Account Responsibility

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to notify us promptly at support@proheadshots.io if you suspect unauthorized access. We are not liable for losses resulting from unauthorized use of your account.

5. Photo Ownership & Usage Rights

Your uploads: You retain ownership of the photos you upload. By uploading, you represent and warrant that:

• You own all photos you upload, or have explicit written permission from the rights holder
• The photos are of you, or of someone who has given you explicit consent to generate AI headshots of them
• The photos do not violate any third-party rights, including copyright, privacy, or publicity rights

License to process: By uploading photos, you grant ProHeadshots a limited, non-exclusive, revocable license to process, transmit, and temporarily store your photos solely for the purpose of providing the Service (generating headshots, supporting your project workflow, and delivering results). This license terminates when your photos are deleted from our systems.

Generated images: You retain rights to the AI-generated headshot images created from your uploads, subject to these Terms. We do not claim ownership of your generated images. You are responsible for how you use them.

6. AI-Generated Content Disclaimer

Important: AI-generated headshots are computer-generated images, not real photographs. While we strive for high quality:

• Results may vary based on uploaded photo quality, lighting, angles, and other factors
• We do not guarantee exact likeness, specific outcomes, or that results will meet any particular professional standard
• Generated images may contain minor imperfections, artifacts, or variations
• AI-generated headshots should not be represented as genuine photographs in contexts where authenticity is legally required
• We do not guarantee that using our headshots will result in professional success, hiring outcomes, dating outcomes, increased business, or approval on any third-party platform

7. Prohibited Uses

You may not use the Service to:

• Generate headshots of anyone without their explicit consent
• Upload photos of minors (anyone under 18)
• Create fraudulent, deceptive, or misleading content
• Impersonate others for malicious, fraudulent, or deceptive purposes
• Create content that violates any laws or regulations
• Upload nudity, sexual content, violent imagery, or other prohibited content as described in our Content Policy
• Use generated images for government-issued identification, legal identity documents, medical records, financial verification, or any regulated purpose where authentic photography is required
• Harass, stalk, threaten, or harm others
• Circumvent security measures, reverse-engineer the Service, or use automated tools to scrape or extract data

8. Payments, Credits & Subscriptions

Payments: All purchases are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service. ProHeadshots does not store your full payment card details.

Credits: Some features of the Service operate on a credits system. Credits are consumed when you use certain features (e.g., generation, premium backgrounds, retouching). Credit balances, usage rules, and included quantities may vary by plan. Credits are non-transferable and may be subject to plan-specific terms.

Subscriptions: If you purchase a subscription, it will automatically renew at the end of each billing period unless canceled. You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of the current billing period. Unused credits or features from a billing period may not carry over, depending on the plan.

Previews: We provide free watermarked previews so you can evaluate the direction of results before purchasing. Previews are not final outputs.

9. Refunds & Guarantee

Refund requests must be submitted to support@proheadshots.io within 7 days of purchase. Refunds are reviewed on a case-by-case basis at our discretion. For full details, see our Guarantee & Refund Policy.

10. Coupons, Discounts & Referral Codes

Coupon codes, discount offers, and referral codes are subject to limitations including expiration dates, maximum redemptions, eligible plans, and one-per-customer rules unless otherwise stated. We reserve the right to modify, limit, or discontinue any promotional offer at any time. Abuse of promotional codes may result in account action.

11. Affiliate & Referral Program

Participation in the ProHeadshots affiliate or referral program is subject to the Affiliate Program Terms. Program participation requires approval and is governed by separate rules regarding commissions, payouts, and conduct.

12. Chargebacks

We encourage you to contact us at support@proheadshots.io before initiating a chargeback with your bank or payment provider. Chargebacks initiated without first contacting support may result in account suspension, loss of access to generated images, and may affect your ability to use the Service in the future.

13. Intellectual Property

The ProHeadshots service, including our AI technology, website design, branding, logos, and content, is protected by intellectual property laws. You may not copy, modify, distribute, reverse-engineer, or create derivative works of the Service or its underlying technology without our written consent.

14. Account Suspension & Termination

We reserve the right to suspend or terminate accounts that violate these Terms, our Content Policy, or our Safety Policy, or that engage in abusive, fraudulent, or harmful conduct. You may delete your account at any time through your account settings or by requesting deletion at support@proheadshots.io. See our Delete Account page for details.

15. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT RESULTS WILL MEET YOUR EXPECTATIONS OR REQUIREMENTS.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PROHEADSHOTS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

17. Indemnification

You agree to indemnify and hold harmless ProHeadshots, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

18. Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law principles, unless otherwise required by the laws of your jurisdiction.

19. Changes to Terms

We may update these Terms from time to time. We will make reasonable efforts to notify users of material changes (e.g., via email or a notice on the Service). Continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree, you should stop using the Service.
